    The amount you receive for your work-related injury is based on the average of your weekly wages for the past 52 weeks. In general, workers will receive two-thirds of their average weekly wages multiplied by the percent of their disability.

    For example, if you were earning an average of $1,000 per week at the time of your injury, and you became 50% disabled due to the accident, you would receive a weekly workers’ compensation benefit of $330 per week. (2/3 x $1000 = $660 /2).

    On the other hand, to qualify for Social Security Disability, a worker must meet the following factors:

    • Worker must be insured under the Social Security Act;
    • Worker must file a claim for disability benefits;
    • Worker must complete a five-month waiting period; and
    • Worker must not have attained normal retirement age.

    Furthermore, under the Social Security Act, a disabled worker must be unable to engage in any substantial gainful activity for any medically determinable physical or mental impairment that is expected to last for at least 12 months.
